1. Who We Are
This Privacy Policy describes how Chard Development Ltd., Chard Property Group Ltd., and their current and future subsidiaries and affiliates (collectively, "Chard Group," "we," "us" or "our") collect, use, disclose, retain and protect personal information.
Chard Group develops, owns and operates multifamily rental residential buildings and undertakes related activities including marketing, leasing, tenancy management, property management, investor relations and corporate administration. We are committed to handling your personal information responsibly and in compliance with applicable privacy laws, including British Columbia's Personal Information Protection Act ("BC PIPA"), Alberta's Personal Information Protection Act ("Alberta PIPA"), the federal Personal Information Protection and Electronic Documents Act ("PIPEDA") and Canada's Anti-Spam Legislation ("CASL").
Our Privacy Officer is responsible for Chard Group's privacy practices and can be reached at the contact information set out in Section 20 below.
2. What This Policy Covers
This Policy applies to personal information we collect about individuals who:
• visit Chard Group websites, including chardproperties.com and our property-specific websites;
• inquire about, apply for or enter into a lease or rental agreement for a property developed or managed by us;
• are current or former tenants, occupants or guarantors;
• invest or consider investing in a Chard Group property or entity;
• apply for employment with us;
• are vendors, suppliers, consultants, contractors or other service providers;
• visit our properties, presentation centres or offices; or
• otherwise interact or correspond with us.
This Policy does not apply to information collected by third-party websites or platforms linked from our websites, even if those links appear on a Chard Group site.
3. Personal Information We Collect
"Personal information" means information about an identifiable individual. It does not include business contact information used solely to communicate with someone in their professional capacity, or information that has been anonymized or aggregated so that it can no longer identify an individual.
Depending on how you interact with us, we may collect:
• Contact information — name, email address, phone number, mailing address;
• Leasing and tenancy information — government-issued identification, date of birth, employment and income information, banking and payment information, credit history, rental references, emergency contacts, vehicle and pet information, proof of insurance;
• Investor information — contact information, banking and payment information, government-issued identification and other information reasonably required for compliance and reporting purposes;
• Employment application information — resume, employment history, references, education, eligibility to work in Canada;
• Service provider information — contact information, insurance, banking information for payments;
• Website and analytics data — IP address, browser type and version, device information, pages visited, time and date of visit, referring URL, cookies and similar identifiers; and
• Communications — correspondence, feedback, survey responses and communications preferences.
4. How We Collect Personal Information
We collect personal information in the following ways:
Directly from you. We collect personal information you provide when you fill out a form on our website, submit a rental application, enter into a lease, make an inquiry, subscribe to a newsletter, visit a presentation centre, invest in a Chard Group property or correspond with us.
Automatically. When you visit our websites, we automatically collect certain information using cookies, web beacons, pixels and similar technologies, including through third-party analytics services such as Google Analytics. See Section 8 (Cookies and Tracking Technologies) for details.
From third parties. We may collect personal information from third parties where you have provided your consent or where permitted by law. This includes credit reporting agencies, current or former employers, current or former landlords, personal references, brokers, referral sources, property managers and financial institutions.
5. How We Use Your Personal Information
We use your personal information for the following purposes:
• to respond to your inquiries, requests and other communications;
• to assess your suitability for a lease, including verifying your identity and creditworthiness;
• to administer your lease or tenancy, including processing rent payments, managing maintenance requests and enforcing lease terms;
• to manage and operate our properties, including safety and security;
• to communicate with you about our properties, services, events, promotions, newsletters and other offerings that may be of interest to you, where we have your consent or are otherwise permitted to do so by applicable law;
• to administer investor relations, including processing investments, distributions and regulatory reporting;
• to process employment applications and administer the employment relationship;
• to administer vendor and service provider relationships;
• to improve our websites, products, services and customer experience, including through analytics and market research;
• to comply with legal and regulatory obligations, including anti-money laundering requirements;
• to protect and enforce our legal rights and to protect the safety, security and interests of Chard Group, our tenants, employees and others; and
• for other purposes described to you at or before the time of collection, or as otherwise permitted or required by applicable law.
6. How We Share Your Personal Information
We may share your personal information with:
• other members of the Chard Group, for the purposes described in this Policy;
• our service providers, including property managers, IT providers, marketing platforms, payment processors, maintenance contractors, legal advisors, accountants and auditors, to the extent necessary for them to provide services to us or on our behalf;
• credit reporting agencies, employers, landlords and references named by you, as part of the rental application process;
• brokers, lenders, investors and governmental authorities (including land title offices, municipalities and regulatory bodies) in connection with property transactions, financings and regulatory compliance;
• third parties in connection with an actual or proposed business transaction involving Chard Group (such as a sale, merger, financing or acquisition), provided the recipient agrees to protect your personal information in a manner consistent with applicable law;
• law enforcement, regulators, courts or other governmental authorities where required or permitted by law, including to comply with a subpoena, warrant or court order, or to protect the rights, safety or property of Chard Group or others; and
• any other third party with your consent or as otherwise permitted by applicable law.
When we share personal information with service providers, we take reasonable steps to ensure they handle it in a manner consistent with applicable law.
7. Your Consent and How to Withdraw It
We collect, use and disclose your personal information with your consent, except where permitted or required by law without consent. Consent may be express (for example, checking an opt-in box on a form) or implied (for example, when you provide personal information in connection with a lease application, your consent to use that information for the purpose of assessing your application is implied).
For marketing communications, we obtain your express consent before sending you commercial electronic messages such as promotional emails, newsletters and announcements, as required by CASL.
You may withdraw your consent at any time, subject to legal or contractual restrictions, by:
• using the unsubscribe link included in any marketing email;
• contacting our Privacy Officer at privacy@chardproperties.com; or
• writing to us at the mailing address set out in Section 20 below.
We will process your withdrawal request promptly. For marketing emails, we will remove you from our mailing list within 10 business days, as required by CASL. Please note that withdrawing your consent may limit our ability to provide certain products or services to you, and we will explain any such consequences at the time of your request.
8. Cookies and Tracking Technologies
Our websites use cookies, web beacons, pixels and similar technologies to collect information about how you use our sites. This helps us improve website functionality, analyze usage patterns, deliver relevant content and measure the effectiveness of our communications.
We may use third-party analytics and advertising services that use cookies and similar technologies to collect and process data about your use of our websites on our behalf. For information about how these service providers handle your data, including how to manage your preferences, please refer to the privacy policies available on their respective websites.
You can manage your cookie preferences through your browser settings. Most browsers allow you to refuse cookies or alert you when a cookie is being set. Disabling cookies may affect your ability to use some features of our websites.
9. Social Media
Our websites and communications may contain links to third-party social media platforms such as Facebook, Instagram, LinkedIn and X (formerly Twitter). When you interact with Chard Group through these platforms, or follow a link from our website to a social media site, you are leaving our website and the social media platform's own terms of use and privacy policy will govern the collection, use and disclosure of any personal information you provide or that is collected about you on that platform.
Any personal information you post on social media platforms is public and may be read, collected and used by others. Chard Group has no control over, and no responsibility for, how third-party social media platforms handle your personal information.
10. Artificial Intelligence and Automated Decision-Making
Chard Group may use artificial intelligence ("AI") tools or automated processes to support our operations and improve our services — for example, to analyze website usage patterns, assist with tenant inquiries, optimize marketing communications or support property management functions.
We do not use fully automated decision-making (i.e., decisions made solely by automated means without meaningful human involvement) to make decisions that have significant legal or similarly significant effects on individuals, such as decisions about lease applications or employment. Where automated tools are used to support such decisions, a qualified person will always review and make the final determination.
Any personal information processed by AI or automated tools is handled in accordance with this Policy and applicable law.
11. Video Surveillance
Chard Group uses video surveillance systems in common areas of certain properties (such as lobbies, parkades, entrances and hallways) for the purpose of protecting the safety and security of tenants, occupants, visitors, employees and property. Video surveillance is never installed inside individual residential units.
Where video surveillance is in use, signage is posted at the property to notify individuals. Video recordings are retained for a limited period and are accessible only to authorized personnel. For more detailed information about our video surveillance practices, including retention periods and access procedures, please refer to our separate Video Surveillance Policy, which is available from our Privacy Officer upon request.
12. Cross-Border Data Transfers
Some of the service providers and technology platforms used by Chard Group (such as property management systems, marketing platforms, cloud storage providers and analytics services) may process or store your personal information at facilities located outside Canada, including in the United States.
When your personal information is transferred outside Canada, it may be subject to the laws of the jurisdiction in which it is stored or processed. Those laws may differ from Canadian privacy laws and may permit courts, government agencies, law enforcement or regulatory authorities in those jurisdictions to access your personal information.
We take reasonable steps to ensure that any service provider that processes your personal information outside Canada provides a comparable level of protection. By providing your personal information to Chard Group, you consent to the transfer, processing and storage of your personal information outside Canada as described in this Policy.
13. Data Retention
We retain your personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, to comply with our legal and regulatory obligations, to resolve disputes and to enforce our agreements. When personal information is no longer required for these purposes, we will securely destroy, erase or de-identify it.
14. Security
We use reasonable administrative, physical and technical safeguards appropriate to the sensitivity of the personal information in our possession to protect it against unauthorized access, collection, use, disclosure, loss or destruction. These safeguards include access controls, encryption where appropriate, secure storage and employee training.
No method of transmission over the internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security.
15. Your Right to Access and Correct Your Information
You have the right to request access to the personal information Chard Group holds about you and to request that we correct any inaccuracies. To make a request, please contact our Privacy Officer using the contact information in Section 20.
We will respond to your request within the timeframe required by applicable law (generally 30 business days under BC and Alberta PIPA). In some cases, we may need to verify your identity before processing your request. A reasonable fee may be charged for access requests in accordance with applicable law.
We may decline a request that is unreasonably repetitive, frivolous or vexatious, that would infringe on the privacy of others, that would violate applicable law, or for other reasons permitted by applicable law.
16. Children
Our websites and services are not directed at children under the age of 13 and we do not knowingly collect personal information from children under the age of 13 without the consent of a parent or legal guardian. If we become aware that we have collected personal information from a child under the age of 13 without appropriate consent, we will delete that information. If you believe we may have collected information from a child under the age of 13, please contact our Privacy Officer.
17. Third-Party Websites
Our websites may contain links to websites operated by third parties. These links are provided for your convenience only. Chard Group has no control over, and is not responsible for, the privacy practices or content of those third-party websites. We encourage you to review the privacy policy of any third-party website you visit.
18. Privacy Breaches
In the event of a breach of security safeguards involving your personal information that creates a real risk of significant harm to you, we will notify you and report the breach to the applicable privacy commissioner in accordance with the requirements of PIPEDA, BC PIPA and/or Alberta PIPA, as applicable. We will also maintain a record of all breaches of security safeguards as required by law.
19. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies or legal requirements. When we make material changes, we will update the "Last Updated" date at the top of this Policy and post the revised Policy on our websites. We encourage you to review this Policy periodically. Your continued interaction with Chard Group after the posting of a revised Policy constitutes your acceptance of the changes.
